Following the publication of the Amsterdam & Partners LLP white paper, “Freedom of Religion Under Attack in Ukraine,” the law firm has released a supplement below detailing the numerous international legal issues facing the passage of Ukraine’s Draft Law 8371, a proposed bill due to be approved next week by the Verkhovna Rada aimed at completing banning the entire Ukrainian Orthodox Church (UOC).

This Legal Analysis of Draft Bill 8371 features rigorously researched and cited findings that demonstrate the fundamental illegality of the draft bill, which fails not one, but all of the thresholds for limits on religion to be enacted under international law.

As Amsterdam & Partners LLP write in the executive summary, “Should Draft Law 8371 pass its second reading, it will be subject to legal challenge in the courts of Ukraine and the European Court of Human Rights. We call on the Ukrainian Government to withdraw Draft Law 8371 from the Verkhovna Rada and honour the rights guaranteed under international law.”
